In 2012, there were significant changes made to the law in Grenada as it relates to the protection of trademarks. The Registration of United Kingdom Trademark Act of 1939, which previously provided for the registration in Grenada of only trademarks registered in the United Kingdom, was repealed by the Trademarks Act, Act No. 1 of 2012, which sets out new conditions for the registration of trademarks in Grenada, without requirement for prior registration in the UK.
Trademark applicants who have their ordinary residence or principal place of business outside of Grenada must be represented in the process by an agent or an Attorney-at-Law qualified to practice in Grenada. In 2011, Grenada took legislative steps towards the introduction of a local Patents Act. However, to date this act has not been made into law to facilitate the registration of Patents in Grenada.
